Tripura High Court Fines TSECL Rs 2,000 in Each of Three Cases Over Power Disconnection

TSECL was fined Rs 2,000 each in three separate writ petitions by the Tripura High Court, which held the power utility responsible for wrongfully disconnecting electricity to three flats in Banamalipur amid a dispute between the developer and the landowner.
Justice T. Amarnath Goud passed the order after hearing petitions filed by the affected flat owners of Binayak Apartment Complex. The petitioners alleged that despite regularly paying their electricity bills, their legally sanctioned power connections were disconnected. They claimed the disconnection stemmed from an ongoing dispute between the flat's developer and the landowner, minister Pranajit Singha Roy, and informed the court that the matter is already pending before civil and consumer forums.
Senior advocates Purushottam Roy Barman and Debalay Bhattacharya, along with advocates Samarjit Bhattacharya, Kaushik Nath, Deepjyoti Paul and Samar Das, appeared for the petitioners. They argued that TSECL disconnected the legally approved power connections without following proper legal procedure and under pressure, depriving the flat residents of an essential service.
The court directed TSECL to immediately restore electricity to the three flats. It also ordered the utility to explain the circumstances and basis on which the connections were disconnected.
The Rs 2,000 fine imposed in each writ petition is being seen as a reflection of the court's displeasure with TSECL's conduct. The order is also being viewed as a warning to electricity utilities against arbitrarily disconnecting valid power connections during property disputes.
The ruling has reignited debate over the cutting off of essential services amid disputes between developers, landowners and flat buyers, with concerns raised that such disputes should not affect the basic services of legally residing flat owners.
